Terms of Service

1. Agreement to Terms

By accessing or using QSLBox ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

2. Your Account

When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Acceptable Use

You agree not to use the Service:

• For any illegal purpose or in violation of any laws or regulations
• To violate, or encourage the violation of, the legal rights of others
• To upload, store, or share content that is illegal, harmful, or offensive
• To interfere with or disrupt the integrity or performance of the Service
• To attempt to gain unauthorized access to the Service or its related systems
• To upload copyrighted material without proper authorization
• To share login credentials or allow others to use your account

QSL Card Content

By uploading QSL cards, you confirm that:

• You own the rights to the images or have permission to use them
• The content does not violate any third-party rights
• The information is accurate and not misleading
• You respect the privacy of individuals featured on QSL cards

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of QSLBox and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries.

Your Content

You retain ownership of the QSL cards and logbook data you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, display, and reproduce your content as part of the Service
• Create backups and ensure the availability of your content
• Process and analyze your data to provide the Service

This license continues even if you stop using our Service, for the purpose of maintaining backups and historical records.

5. Subscriptions and Payments

Free Tier

We offer a free tier with limited storage (100MB). This tier may have reduced features and is subject to change at any time.

Paid Subscriptions

Paid subscriptions are billed on a recurring basis (monthly or annually). By choosing a paid subscription, you agree to pay the applicable fees.

Payment Processing

We use PayPal for payment processing. All payments are subject to PayPal's terms and conditions. We do not store or process your credit card information.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial months or years.

Price Changes

We may change subscription prices at any time. Price changes will be communicated at least 30 days in advance and will take effect at the start of the next subscription period.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

We will retain your data for 30 days after account termination, after which it will be permanently deleted. You are responsible for downloading your data before termination.

7. Limitation of Liability

In no event shall QSLBox, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

The Service is provided "as is" and "as available" without any warranties of any kind.

8. Indemnification

You agree to defend, indemnify and hold harmless QSLBox and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• A breach of these Terms
• Content you post on the Service
• Your violation of any third-party rights

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
